New Electrical Safety Standards Regulations in the Private Rented Sector

The new Electrical Safety Standards regulations in the Private Rented Sector (England) that came into force last year required all new landlords entering into a new tenancy to hold an accurate electrical inspection condition report (EICR). Starting from the 1st of April 2021, the government will extend these regulations to all landlords - including those of currently tenanted properties.

Obtaining a new EICR certificate

We recommend all landlords act quickly and book an electrician as soon as possible. Due to the increased demand for EICR tests and the ongoing lockdown measures, it is vital to make early plans for conducting the safety checks to allow time for any remedial works, if required. With the April deadline fast approaching, it is essential to act now.

Should the property fail to pass the tests for required electrical standards, the landlord will have 28 days to carry out any remedial works to ensure tenants and other residents' safety in the surrounding properties.

Once the work has been carried out, the engineer must provide the landlord with written evidence on completion. It should detail the work that has been carried out and that the required standards have now been met. The landlord must provide the tenants with proof that the property is now safe and meets all appropriate requirements.

Enforcement of the new Legislation

All landlords starting from the 1st of April will have seven days to provide an EICR certificate should a local authority request one. Should the landlord be found in breach of new regulations, the local authority is in a position to impose a fine of up to £30,000.

Local authorities can arrange any remedial actions required should the landlord fail to do so within the 28-day window.  Should emergency remedial works be conducted by the local authority on the property, the bill and/or the fine will be presented to the landlord.
